1. "ผู้เช่า" ให้สัญญาว่า จะไม่นำรถยนต์คันที่เช่าไปให้บุคคลอื่นเช่าช่วง หรือนำไปให้บุคคลอื่นใช้งาน โดยไม่ได้รับอนุญาตจาก "ผู้ให้เช่า" หรือนำไปใช้ในทางที่ผิดฏหมาย ซึ่งหากมีขึ้นและเกิดความเสียหายใดๆ ผู้เช่าจะต้องเป็นผู้รับผิดชอบแต่ผู้เดียว

2. "ผู้เช่า" ให้สัญญว่า หากรถยนต์คันที่เช่าเกิดอุบัติเหตุเฉี่ยวชนเสียหาย และทำให้เกิดความเสียหายแก่ชีวิต ร่างกายหรือทรัพย์สินของผู้เช่าหรือบริวารของผู้เช่า หรือบุคคลภายนอก ไม่ว่าจะเกิดขึ้นด้วยเหตุวิสัยหรือเหตุใดก็ตาม ผู้เช่ายอมรับผิดชอบแต่เพียงผู้เดียว

3. เมื่อรถยนต์คันที่เช่าเกิดอุบัติเหตุเฉี่ยวชนเสียหาย โดยฝ่ายผู้เช่าเป็นฝ่ายประมาทเลินเล่อทำให้เกิดความเสียหาย และรถยนต์คันที่เช่าต้องทำการจอดซ่อมแซม ผู้เช่ายินดีรับผิดชอบชดใช้ค่าเสียหายเป็นค่าเช่าระหว่างที่รถยนต์จอดซ่อมแซมให้แก่ผู้ให้เช่า และ "ผู้เล่า" จะต้องแจ้งให้ผู้ให้เช่าทราบถึงเหตุผลและพฤติการณ์ พร้อมทั้งชื่อ ที่อยู่ของผู้เกี่ยวข้องในทันที และให้ความร่วมมือในการดำเนินการต่างๆ ในอุบัติเหตุที่เกิดขึ้น

4. "ผู้เช่า" ให้สัญญาว่าหากรถยนต์คันที่เช่าชำรุดเสียหาย หรือสูญหาย ผู้เช่าจะรับผิดชอบชดใช้ค่าเสียหายให้แก่ผู้ให้เช่าในกรณีที่ผู้ให้เช่าได้รับชดใช้ค่าสินไหมทดแทนจากบริษัทประกันภัยแล้วยังไม่คุ้มราคารถยนต์และอุปกรณ์ จนกว่าจะครบถ้วน

5. "ผู้เช่า" ให้สัญญาว่า กรณีที่บริษัทประกันภัยปฏิเสธการชดใช้ค่าสินไหมทดแทนในอุบัติเหตุที่เกิดขึ้น อันเนื่องมาจากฝ่ายผู้เช่ากระทำผิดเงื่อนไขของกรมธรรม์ประกันภัย เช่นฝ่าฝืนสัญญาณหรือเครื่องหมายจราจร, เมาสุรา, หรือมีเจตนาทำให้รถประกันเกิดความเสียหาย เป็นต้น ผู้เช่าจะต้องรับผิดชอบชดใช้ค่าสินไหมทดแทนให้แก่ผู้ให้เช่าจนกว่าจะครบถ้วน

6. "ผู้เช่า" ให้สัญญาว่า จะรักษามาตรวัดระยะทาง รวมทั้งอุปกรณ์ เครื่องประดับตกแต่ง เครื่องมือ เครื่องใช้ประจำรถให้อยู่ในสภาพที่ใช้การได้ดีเหมือนเดิมอยู่เสมอ

7. "ผู้เช่า" ให้สัญญาว่า จะเก็บรักษาดูแลรถยนต์คันที่เช่าไว้ในสถานที่ปลอดภัย และจะแจ้งสถานที่เก็บรักษาให้ผู้ให้เช่าทราบหากมีการเปลี่ยนแปลงที่เก็บรักษาจะแจ้งให้ผู้ให้เช่าทราบทันที

8. "ผู้เช่า" ให้สัญญาว่า จะนำรถยนต์คันที่เช่ามาส่งมอบคืนแก่ผู้ให้เช่าตามกำหนดเวลาใน (ข้อ 1.) หากผิดนัดให้ริบเงินมัดจำที่วางประกันไว้ตาม (ข้อ 2.) ทันที ทั้งนี้ไม่รวมถึงค่าเสียหายอย่างอื่น กรณีที่ผู้เช่าไม่ส่งมอบรถยนต์คืนไม่ว่าด้วยเหตุสุดวิสัยหรือเหตุอื่นใดผู้เช่ายอมรับผิดชอบชดใช้ราคายนต์หรือค่าเสียหายอื่นใด และค่าใช้จ่ายในการติดตามเอารถยนต์คืน

9. หากผู้เช่าประพฤติผิดสัญญาข้อใดข้อหนึ่ง ผู้เช่ายอมให้ริบเงินมัดจำที่วางประกันไว้ และหากไม่ส่งมอบรถยนต์คืนให้แก่ผู้ให้เช่าภายใน 3 วัน นับแต่ผู้เช่าผิดสัญญาแล้ว ให้ถือว่าสัญญาเช่าเป็นอันระงับลงทันที โดยผู้ให้เช่าไม่ต้องบอกกล่าวเลิกสัญญาเช่าแต่อย่างใดและหากผู้เช่ายังไม่ส่งมอบรถยนต์คันที่เช่าคืนให้กับผู้ให้เช่า ผู้เช่ายินยอมอนุญาตให้ผู้แทนหรือพนักงานของผู้ให้เช่าเข้าไปยังสถานที่ของผู้เช่าหรือสถานที่เพื่อยึดรถยนต์คืนทั้งนี้โดยไม่จำต้องแจ้งให้ผู้เช่าทราบล่วงหน้า และไม่ว่าในเวลานั้นผู้เช่าจะอยู่ในสถานที่นั้นหรือไม่ก็ตาม และให้ถือว่าผู้เช่ามีเจตนาทุจริตยักยอกทรัพย์สินรถยนต์คันที่เช่าและยินยอมให้ผู้ให้เช่าเข้าแจ้งความร้องทุกข์ดำเนินคดีทางอาญาและทางแพ่งได้ทันที

10. คู่สัญญาตกลงกันว่าหากมีข้อพิพาทใดๆ เกิดขึ้นจากสัญญานี้ให้เสนอคดีต่อศาลชั้นต้นในกรุงเทพมหานคร คู่สัญญาทั้งสองฝ่ายได้อ่านและเข้าใจข้อความในสัญญานี้โดยตลอดแล้วเห็นว่าถูกต้อง จึงได้ลงลายมือชื่อไว้เป็นสำคัญ

1. The lessee promises that the leased car will not be sub-leased or allowed to be used by the other person without the approval of the lessor or used illegally. If this done and damage occur the lessee must be responsible solely.

2. The lessee promises that if the leased car has an accident, a crash or is damaged and causes loss of life, physical injury or properties of the lessee or the dependants of the lessee or the outsiders whether it be an unavoidable circumstance or out of any reason the lessee must solely be responsible.

3. When the leased car has an accident or crash and causing damages throughcarelessness of the lessee and the leased car requires repair the lessee is willing to make compensation to the lessor being the rental during the period the leased car is under repair and the lessee promises to advise the lessor of such incident and the circumstance together with the name and the address of the involed party immediately and to co-operate in taking necessary actions concerning the accident occurred.

4. The lessee promises that if the leased car is damaged or lost the lessee will be responsible in making compensation for such damages to the lessor in the case the lessor has received the compensation from the insurance company but still does not cover the price of the car and accessories until fully paid.

5. The lessee promises that in case the insurance company refuses to make any compensation for the accident occurred due to the lessee having breached the conditions of the insurance policy such as violation of traffic signals or traffic signs, being drunk or having an intention to damage the insured car etc., the lessee must be responsible in making compensation to the lessor.

6. The lessee promises to keep the meter including accessories, furniture, tools car appliances to be in usable condition as before.

7. The lessee promises to take care of and keep the leased car at safe place and will advise such place to the lessor. If there is any change of place the lessee will advise the lessor immediately.

8. The lessee promises to deliver the leased car to the lessor under the lease period in item (1). If the lessee is defaulted the guarantee money in item (2). shall be forfeited immediately excluding other damages. In case the lessee fails to deliver the leased car owing to any unavoidable circumstance or out of any other reason the lessee agrees to compensate for the price of the leased car or any damages and the expenses in recovering the leased car.

9. If the lessee breaches any item, the lessee agrees for the guarantee money deposited to be forfeited and if the lessee fails to return the car to the lessor within 3 days from the date the lessee is defaulted this agreement shall be considered as terminated immediately without any notice of termination of the agreement whatsoever and if the lessee still does not delivery the leased car to the lessor, the lessee agrees to let the representative or the employee of the lessor enter the promises of the lessee to seize the leased car without any prior notice to the lessee and whether the lessee will be in such premises during that time or not and it shall be considered that the lessee has a dishonest intention to embezzle the leased car and agrees to let the lessor file a complaint to take legal action on criminal and civil charge immediately.

10. Both parties agree that if any dispute occurred in relation to this agreement the lawsuit will be made at the Civil Court in Bangkok Metropolis.
